Legal Malpractice cases pose certain challenges and complexities unlike other tort cases. They essentially require the litigator to assemble and prove a case within a case. Generally, in order to recover on a claim for legal malpractice, the client must demonstrate the existence of an employment relationship between the attorney and client, that the attorney neglected a reasonable duty owed to the client, and that the breach of duty was the direct and proximate cause of an actual loss to the client. The client must show that he would have prevailed on the underlying action but for the attorney's negligence.
